Case filed against Raghuji Pant by Komal Oli


Kathmandu: Singer and National Assembly member Komal Oli have filed a defamation suit against CPN leader Raghuji Pant. Oli filed a case in the Kathmandu District Court on Tuesday against Pant's public remarks against her a few days ago. She has filed a case based on Articles 305, 306, and 307 of the Criminal Code, 2074 BS.

In a program on March 3, Pant said, "Our party has had women without marriage for the last 20 years. There are such women in KP's party as well. But she did not get a ticket. When Komal Oli sang a song "Poila Jana Pam" by showing her knees and ankles, she became a Member of Parliament."

"The nefarious intention of the opposition to spread propaganda in politics by deliberately making me a representative and insulting women as a whole is heinous violence against women," Oli said in her complaint.

'When it is clear that my personal character, conduct, morals, or character have been insulted and murdered to hurt or insult my dignity and that it has been expressed in a way that hurts my reputation and dignity by publicizing, disseminating, and publishing it. As he has violated Article 305 (1) (2) of the Code of Criminal Procedure, 2074 BS. Punishment as per Section 305 (3) and Section 306 (1) (2) (a) of the Act for insulting me. Punishment as per Section 307 (1) of the Act. As the Opposition has insulted me electronically, one more year imprisonment and ten thousand fine. Let's get punished up to the limit. Also, considering the seriousness of the offense as per sub-section (2) of 207 of the Act and the impact on my reputation as well as the humiliation caused by electronic and other mass media, reasonable compensation and expenses incurred in the case should be paid by the Opposition.


How much punishment can be given to Pant?

Articles 305, 306, and 307 of the Criminal Code 2074, 2074 have the following provisions:


According to sub-section 1 of section 307 of the Criminal Code, 2074 BS, Pant could be imprisoned for two years or fined up to Rs 20,000 or both. But Oli has demanded imprisonment for one more year and a fine of up to Rs 10,000 for insulting her through electronic or other mass media. Oli has also demanded from the Pant to pay the expenses incurred in the case along with proper compensation.
